These Terms of Service ("Terms") govern your access to and use of the DentalTune website and any audit, tune-up, or maintenance services described on it (collectively, the "Services"). By browsing this website or submitting a request through our Free 10-Minute Mobile Audit form, you agree to these Terms. If you do not agree, please do not use the Services.

1. About DentalTune

DentalTune provides website performance audits, optimization ("tune-ups"), and ongoing maintenance services specifically for dental practices, with the aim of improving site speed, mobile usability, and patient booking conversion.

2. The Free 10-Minute Mobile Audit

The Free 10-Minute Mobile Audit is provided for informational and diagnostic purposes only. It reflects our assessment of your website's speed, mobile usability, and booking flow at the time the audit is performed, using automated tools and general industry benchmarks. Submitting a request for an audit does not create any obligation on your part to purchase or continue with any paid service, and does not create any obligation on our part to guarantee specific business outcomes, patient bookings, or search rankings. Audit findings and recommendations are provided "as is" and should not be relied upon as a substitute for your own independent judgment regarding your website or business.

3. Paid Services

Any paid engagement — including one-time optimization packages or ongoing monthly maintenance plans — is subject to a separate agreement, quote, or order confirmation between DentalTune and your practice, which will set out specific pricing, deliverables, and timelines. Where any such separate agreement conflicts with these Terms, the separate agreement will govern with respect to that engagement.

4. Acceptable Use

You agree not to use this website or the audit request form to:

  • Submit false, misleading, or fraudulent information;
  • Submit a website URL you do not own or have authorization to have audited;
  • Attempt to interfere with, disrupt, or gain unauthorized access to our systems; or
  • Use the Services for any unlawful purpose.

5. Intellectual Property

All content on this website, including text, graphics, logos, and the DentalTune name and mark, is owned by or licensed to DentalTune and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our branding without our prior written consent.

6. Disclaimer of Warranties

This website and the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.

7. Limitation of Liability

To the fullest extent permitted by law, DentalTune and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of this website, the Free 10-Minute Mobile Audit, or any related Services, even if advised of the possibility of such damages. In no event will our total aggregate liability arising out of or relating to these Terms or the Services exceed the amount, if any, actually paid by you to DentalTune for the specific paid service giving rise to the claim in the six (6) months preceding the event giving rise to liability.

8. Third-Party Links and Tools

Our website and audit reports may reference or link to third-party tools, services, or websites that are not owned or controlled by DentalTune. We are not responsible for the content, accuracy, or practices of any third-party sites or services.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the website or Services after any changes take effect constitutes your acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.

10. Governing Law & Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada.
